Updated August 2026: Whether you need a business to start TikTok Shop depends on what role you mean by “start TikTok Shop.” An Affiliate Creator, an individual seller, a business seller, an Official Shop Creator and a Marketing Creator do not all have the same requirements.

For TikTok Shop US, the short answer is:

  • Affiliate Creator: you do not need to form an LLC or other company just to apply as an Affiliate Creator, but you must meet TikTok Shop’s creator eligibility and identity requirements.
  • Individual seller: you can currently register as an individual selling under your own name without a registered business entity, but TikTok requires US residency, identity, address, tax and banking information.
  • Business seller: if you register a corporation or partnership, TikTok requires business information such as the legal entity details, EIN, business address and ownership/representative information.
  • Official Shop Creator or Marketing Creator: these creator accounts are bound to a seller account. They are not the same thing as an independent Affiliate Creator.

So “you need a phone and an internet connection” is useful motivation, but it is not a complete description of TikTok Shop eligibility in 2026. You may not need to form a company, but you do need to satisfy the rules for the specific account type you want to use.

Quick Answer: Do You Need a Business for TikTok Shop?

No, not always. TikTok Shop US currently allows both individual creators and individual sellers in certain circumstances. A formal LLC, corporation or partnership is not universally required.

But “no business required” does not mean “no verification required.” TikTok Shop has separate identity, age, residency, tax, banking and business-verification rules depending on whether you are joining as a creator or seller.

The first question should therefore be: Are you trying to promote other people’s products, or are you trying to open a shop and sell products yourself?

If You Want to Be a TikTok Shop Affiliate Creator

An Affiliate Creator promotes products from TikTok Shop sellers and can earn commissions from qualifying sales. You do not need your own TikTok Shop seller account and you do not need to create an LLC just to become an Affiliate Creator.

For TikTok Shop US, TikTok’s current Creator Eligibility Policy says Affiliate Creators must self-apply, have at least 1,000 followers, be at least 18, be based in the United States, meet its policy and account-history requirements, and pass the applicable creator identity-verification process.

TikTok currently asks eligible Affiliate Creators for personal identity information such as their name, date of birth, address and accepted government-issued identification as part of creator verification. A business entity does not replace that personal eligibility process.

If You Want to Open a TikTok Shop as an Individual Seller

This is where the old “you need a business” question becomes more nuanced.

TikTok Shop US currently has an Individual seller registration type. TikTok defines this as selling under your own name rather than as a registered business.

That means you do not necessarily need to form an LLC, corporation or partnership before opening a US TikTok Shop as an individual seller.

However, TikTok’s current US individual-seller onboarding guidance requires applicants to be at least 18 and reside in the United States. TikTok also requires verification information that can include:

  • legal name
  • date of birth
  • physical residential address
  • accepted US identity documentation
  • the last four digits of an SSN or an ITIN
  • bank-account information
  • proof of address when requested
  • tax information, including a W-9 in TikTok’s current individual-seller guidance

In other words, “individual seller” means no separate registered entity is required; it does not mean TikTok lets you sell anonymously or without tax and identity verification.

When Do You Need Business Details?

If you register TikTok Shop US as a corporation, partnership or other supported business entity rather than as an individual, TikTok requires business-level verification.

TikTok’s current US corporation/partnership onboarding guidance includes requirements such as a US business address, legal business information, an EIN, ownership or ultimate-beneficial-owner information, details for business representatives and appropriate banking information.

This is the situation where an LLC or other entity can be relevant: because you are actually registering and operating as that business entity, not because forming an entity creates creator eligibility that you otherwise do not have.

Affiliate Creator vs Seller: The Most Important Distinction

Many beginner explanations mix these two roles together.

Affiliate Creator

You promote products sold by other TikTok Shop sellers. The seller is responsible for the product listing, inventory, order fulfilment, shipping and seller-side customer obligations. You earn commission on eligible attributed orders.

Seller

You operate the shop that sells products. That means completing seller onboarding and taking on the seller-side operational and compliance responsibilities. You may register in an available individual or business-entity category if you meet that category’s requirements.

You therefore should not form a business merely because an Affiliate Creator tutorial tells you “TikTok Shop needs an LLC.” Affiliate Creator eligibility and seller registration are separate processes.

What Is an Official Shop Creator?

An Official Shop Creator is a creator account bound to a TikTok Shop seller as that shop’s official creator account.

TikTok’s current US Creator Eligibility Policy says an Official Shop Creator does not need a minimum follower count simply to be bound to the shop. The account must be invited through an official creator bind and use the same account name as the bound TikTok Shop.

Official Shop Creators can promote products from their bound shop, but they do not have the same independent Affiliate Product Marketplace access as a standard Affiliate Creator. TikTok’s current policy also exempts Official Shop Creators from the separate creator identity-verification process that applies to Affiliate Creators, because the creator relationship sits within the verified seller structure.

What Is a Marketing Creator?

A Marketing Creator is also bound to a TikTok Shop seller, but it is not required to use the same account name as the shop.

TikTok says there is currently no minimum follower requirement simply to bind a Marketing Account to a seller for self-selling. However, a Marketing Creator needs at least 5,000 followers to request affiliate permissions for access to the TikTok Shop Product Marketplace and promote products from other sellers.

Marketing Creators may also need to complete creator identity verification when accessing the Product Marketplace to earn commissions.

This is another reason not to use “TikTok Shop creator” as if it describes one universal account type.

What About the TikTok Shop Creator Pilot?

Business status does not remove TikTok Shop’s creator pilot rules.

Under TikTok’s current US policy, verified Affiliate Creators with fewer than 5,000 followers are automatically enrolled in the Affiliate Creator Pilot Program for at least 30 days. Official and Marketing creators can instead be subject to TikTok’s separate Early-Stage Pilot after binding to a seller.

My Experience Using a US LLC From Australia

In my own earlier TikTok Shop experience, I created a Wyoming LLC while operating US TikTok Shop accounts from Australia. I also obtained a US EIN and opened a US business bank account.

That was my genuine business setup at the time, and I am keeping it here because it is part of my first-hand experience.

However, I would not present that historical setup as a current eligibility method for an Australian creator. TikTok Shop US’s current creator rules say creators covered by the US policy must be based in the United States. What Does TikTok Shop Mean for Australians in 2026?

TikTok’s Australian newsroom has highlighted Australian brands generating TikTok Shop sales in overseas markets such as the US and UK. That demonstrates that Australian businesses can participate in TikTok’s broader commerce ecosystem in certain cross-border circumstances.

It does not mean an Australian resident automatically qualifies for a TikTok Shop US individual seller account or US Affiliate Creator account. Those US onboarding routes have their own residency and verification requirements.

For an Australian reader, the sensible approach is to check the current Shop and monetisation options available to your actual account, business and market rather than trying to reproduce a US setup that does not match your circumstances.

What You Actually Need as an Affiliate Creator

If you legitimately qualify for TikTok Shop Affiliate in your market, the operational setup can still be simple. You generally do not need employees, warehouse space, delivery drivers or your own inventory merely to promote another seller’s products as an affiliate.

Your practical tools can be as simple as a suitable phone, internet access and products or samples you are allowed to create content around. The seller remains responsible for the seller-side fulfilment operation.

What About Taxes?

Not having a separate company does not mean income is outside the tax system.

TikTok’s current US individual-seller onboarding explicitly asks for tax-related information, including SSN/ITIN information and a W-9. Creator commission and tax requirements can also depend on your circumstances and market.

  • You want to sell under your own name: check whether TikTok’s individual seller route is available to you and whether you satisfy its residency, ID, tax, address and banking requirements.
  • You already operate a registered company: use the appropriate business-seller onboarding route and be prepared to verify the entity, owners and representatives.
  • You want a creator account attached to your shop: understand whether you need an Official Shop Creator or Marketing Creator bind rather than assuming you need a separate Affiliate Creator account.
  • You are outside the US: check your actual market eligibility first. Do not assume a US entity or technical location workaround substitutes for residency or identity requirements.
